Mike Lee is a scholar and passionate defender of the Constitution. He has spoken to thousands of people about the importance of and the need to preserve the Constitution. Everything from the Due Process Clause to the Presentment Clause was discussed around the Lee family’s dinner table, almost in the same way many families talk about the weather, school, or the day’s events. As a result, at a very young age Mike acquired a great love of and admiration for the Constitution and for the principles it is based on.

After graduating from Law School in 1997, he served as a law clerk to Judge Dee Benson of the U.S. District Court for the District of Utah. Following his time with Judge Benson he clerked for then-Judge Samuel A. Alito, Jr., who was serving at that time on the U.S. Court of Appeals for the Third Circuit Court. From there he went into private practice, joining the Washington, D.C. office of Sidley & Austin, where he specialized in appellate and Supreme Court litigation. Several years later, Mike returned to Utah after being invited to serve as an Assistant U.S. Attorney in Salt Lake City, preparing briefs and arguing cases before the U.S. Court of Appeals for the Tenth Circuit. He served as Governor Huntsmans General Counsel from January 2005 until June 2006, when he returned to Washington to serve a one-year clerkship at the U.S. Supreme Court with Justice Alito.

Mike returned to Utah (and to private practice) in the summer of 2007, joining the Salt Lake office of the Washington, D.C.-based law firm of Howrey LLP. Mike has earned a reputation as a truly outstanding lawyer based on his sound judgment, unsurpassed writing, courtroom advocacy skills, and thorough understanding of the Constitution (and of federal law generally).

Is this the policies of a Conservative?

Sarah campaigned in Wasilla as a "fiscal conservative." During her 6 years as Mayor, she increased general government expenditures by over 33%. During those same 6 years the amount of taxes collected by the City increased by 38%. This was during a period of low inflation (1996-2002). She reduced progressive property taxes and increased a regressive sales tax which taxed even food. The tax cuts that she promoted benefited large corporate property owners way more than they benefited residents.

The huge increases in tax revenues during her mayoral administration weren’t enough to fund everything on her wish list though, borrowed money was needed, too. She inherited a city with zero debt, but left it with indebtedness of over $22 million. What did Mayor Palin encourage the voters to borrow money for? Was it the infrastructure that she said she supported? The sewage treatment plant that the city lacked? or a new library? No. $1m for a park. $15m-plus for construction of a multi-use sports complex which she rushed through to build on a piece of property that the City didn’t even have clear title to, that was still in litigation 7 yrs later — to the delight of the lawyers involved! The sports complex itself is a nice addition to the community but a huge money pit, not the profit-generator she claimed it would be. She also supported bonds for $5.5m for road projects that could have been done in 5-7 yrs without any borrowing.

Look things up before voting for yourself unless you’re one of those bots that only vote party.

Republicans are wolves in sheep’s clothing. They are all liars and elitist. They don’t care about the poor or suffering. Look what Bush has done in the last 8 years….look at the economy, gas prices, healthcare, unemployment, environment, etc….all choas from thos damn REPUBLICANS!!!

What are my chances of IRS audit with 1098-T?

Let’s say my wife gets a 1099-T from her university with only 2 numbers: $17,000 billed (box 2) and $10,000 scholarship (box 5). There is a difference of $7000 that could have potentially been paid to the University and is deductible.

How would the IRS know if this was actually paid by me and was not the result of some other scenario? Do they get any additional information from the school and are my chances of being audited if I claim the full $7000 deduction?

The amount of any scholarships that is used for tuition and fees cannot be used for the education credits or deduction. HOWEVER there are some things that CAN be paid for with scholarship proceeds that are not qualifying tuition and fees for the credits or deduction. Books, equipment, living costs such as room and board in the dorms or apartment costs are all eligible costs for scholarships but don’t qualify for the credits or deduction.

At audit, your records will determine what is legit and what is not. Use your scholarships first for items that don’t apply for the education credits if at all possible. Then use the remainder for tuition and fees. Whatever tuition and fees are then paid out of your own pocket or with loan proceeds are eligible for the credits or deduction.

How and when we are paid, whether for services or
property, can influence the amount of tax we have to
pay. That seems so obvious that no one would need to
say it, much less prove it. Nevertheless, in civil litigation,
the extent to which you can get damages for adverse tax
consequences has been a thorny subject. We all know that
tax consequences dramatically impact the value of what
we receive. Yet, many courts have been loath to gross
up the amount of a plaintiff ‘s damages by the amount of
corresponding taxes the plaintiff must pay.
This is a damages question not a tax question,

What is your opinion of Anne Kilkenney’s e-mail about Sarah Palin’s "experience" as an Alaskan Politician?

If you’re wondering, Anne is a citizen of Wasilla, Alaska, who has sent out an e-mail to inform us of how Sarah Palin ran their small town and the Alaskan Government. Apparently, Palin left the town a 22 million dollar debt, ran her gubernatoral campaign in support of the "bridge to nowhere", and has drained a state surplus.

Here is an excerpt:

gotten herself into some trouble over precipitous firings which had
given rise to a recall campaign.
